Welcome to 2026: A Few Practical Legal Checks Worth Doing Now
Happy New Year and welcome to 2026. For many Kiwis, January is when plans get made: a property move, a new business goal, a renovation, or simply getting life admin back under control. The legal tip we repeat most often is also the simplest: get advice before you need it. It is almost always faster, cheaper, and far less stressful to prevent a problem than to untangle one later.
If property is on your radar this year, start early. Before you sign anything, get the Sale and Purchase Agreement reviewed and make sure your key conditions are right for the property and your situation (finance, building report, LIM/title review, KiwiSaver deposit timing if relevant). If you are heading to auction, remember you do not get the same “sign first, check later” window, your due diligence needs to be done before you bid.
For business owners, 2026 is a good time to review the foundations: are your Terms of Trade current and suited to how you actually get paid, deliver work, and resolve disputes? If you have business partners, consider whether a shareholders’ agreement is in place (or needs updating) so expectations are clear before pressure hits.
For families, a quick check of your will, enduring powers of attorney, and trust arrangements can save significant difficulty later - especially after a major life change.
And for committees and community groups, keep the Incorporated Societies Act 2022 re-registration requirements on your 2026 to-do list.
