If you've ever bought or sold a property in New Zealand, you've heard the word conveyancing. But what does it actually mean, and why does it matter?

Conveyancing is the legal process of transferring ownership of property from one person to another. It sounds straightforward, but there's quite a lot happening behind the scenes to make sure that transfer is clean, legal, and properly protected.

What happens at each stage

It starts the moment a Sale and Purchase Agreement is signed. Your lawyer reviews the agreement, checks the title, investigates any easements, covenants, or encumbrances registered against the property, and makes sure there are no surprises hiding in the fine print.

During the due diligence period, your lawyer will also liaise with your bank if you're financing the purchase, ensure LIM and building reports are reviewed, and raise any issues that could affect your decision to proceed.

Once conditions are satisfied, the focus shifts to settlement, coordinating with the other party's lawyer, preparing settlement figures, and ensuring funds and title transfer on the right day.

Where people come unstuck

The most common issues we see are buyers who don't read the agreement carefully before signing, or who treat conveyancing as a tick-box exercise rather than proper legal protection.

A poorly worded condition, an issue with the title, or a missed clause around chattels can cause significant problems, and by the time most people notice, options are limited.
